1. This is the agreement between the Buyer, and the LEDfoot manufacturer and Seller for the purchase of the LEDfoot controller, or the Equipment.

2. WARRANTY: SELLER warrants the Equipment for 90 days from the day of its delivery, subject to terms and conditions described on the LEDfoot product page, also included below. SELLER MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, AS TO THE DESIGN, OPERATION, OR AS TO THE QUALITY OF THE MATERIAL OR WORKMANSHIP IN, THE EQUIPMENT AND ALL WARRANTIES INCLUDING WARRANTIES OF, MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OF THE EQUIPMENT ARE HEREBY EXCLUDED. BUYER AGREES THAT SELLER WILL IN NO EVENT BE LIABLE FOR DAMAGES ARISING IN STRICT LIABILITY OR FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, HOWEVER ARISING. SELLER’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE PURCHASE PRICE OF SUCH ITEM OF EQUIPMENT SET FORTH IN THE RETURN POLICY BELOW.

3. RETURNS and WARRANTY SUPPORT REQUESTS will be honored within 90 days of Buyer receiving the item. All returns and replacements require a return authorization which can be requested by contacting the Seller. For any kind of a return Buyer will be responsible for covering the return shipping cost. Dead-on-arrival (DOA) Equipment or Equipment that fails within first 90 days will be replaced or given a refund, as per Buyer’s preference. Refunds will be processed after the returned item has been received by the Seller. Refunds are subject to Paypal refund processing times. Any item with visible damage due to Buyer error WILL NOT be issued a refund. Please note that Paypal charges sellers a credit card transaction fee (as of July 2021 this amounts to approximately 3%, or $4-6 per order, depending on the shipping costs). As a result, when issuing a refund, any refund will be reduced by this same amount. Considering that Paypal assesses this fee on all orders, including preorders, preorders that are cancelled as per Buyer’s request prior to shipping of the Equipment will be subject to this same fee. The only exception to the fee will be orders that are for whatever reason not possible to fulfill by the Seller, which will be issued a full refund.

3. The Equipment has been tested to ensure it is free of defects that would prevent its correct operation. Given that for it to properly operate it needs to be installed and that the Buyer’s vehicle modifications may interfere with the Equipment, Buyer takes full responsibility for its installation and maintenance. Buyer is also aware that if such an installation is performed incorrectly, it may result in injury, property damage, and even death, and takes full responsibility for the Equipment installation and any results, direct or indirect related to the outcome of the installation, maintenance, and use.

4. Buyer acknowledges that while LEDfoot’s heatshrunk tubing enclosure is designed to protect it from the elements, it is not waterproof and that it should not be placed outside the fuse box. Buyer acknowledges that failure to do so may result in damage to the Equipment, the vehicle within which it is installed, and the vehicle surroundings, injury, and even death.

5. It is Buyer’s responsibility to ensure that the Equipment, its installation on a vehicle, and any patterns the Buyer uses comply with National, State, and Local laws and Ordinances.

6. This Equipment Purchase Agreement is valid without the Buyer’s signature. It becomes effective upon the preorder or purchase of the Equipment.
